Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Petromap (the "Service"), available at petromap.eu and any related domains, applications, or APIs operated by Backup Experts SRL ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Permitted use

You may use the Service for your own personal, non-commercial purposes - to look up fuel prices and station information for your own travel and purchasing decisions. You may register a free account to save favorites, submit station reports, and leave reviews. You agree to use the Service in compliance with all applicable laws and these Terms.

3. Prohibited conduct - automated access, scraping, and data extraction

The Service is intended for manual, interactive use by individual end users. We invest significant effort and resources in collecting, normalizing, enriching, and presenting fuel price data across Europe. The aggregated result of that work is protected under Romanian and European Union law, including but not limited to Directive 96/9/EC on the legal protection of databases.

Without our prior written consent, you must not:

• Access the Service using any bot, crawler, spider, scraper, headless browser, or other automated means;
• Perform bulk downloads, mirroring, caching, or systematic extraction of any part of the Service, its data, or its API responses;
• Reverse engineer, intercept, or replay any internal or undocumented API endpoints used by the Service;
• Circumvent, disable, or interfere with any rate limits, access controls, authentication mechanisms, CAPTCHAs, or other security measures;
• Republish, redistribute, resell, sublicense, or otherwise make available any data obtained from the Service, whether in original, transformed, or aggregated form;
• Use the Service or its data to train, fine-tune, evaluate, or otherwise develop any machine learning model, language model, or competing data product;
• Impose an unreasonable or disproportionately large load on our infrastructure, or interfere with the normal operation of the Service for other users.

If you have a legitimate need for programmatic access to our data - for research, journalism, or a commercial application - contact us. Licensing terms are available on request.

Violations may result in immediate blocking of your access, termination of your account, and legal action to recover damages, costs, and any profits derived from unauthorized use.

4. User accounts

If you create an account, you agree to provide accurate information and to keep your password secure. You are responsible for all activity under your account. You must not share your account with others or create multiple accounts to evade restrictions. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for abusive, fraudulent, or automated access.

5. User-submitted content

The Service allows registered users to submit content such as price reports and station reviews. By submitting content, you:

• Confirm that it is accurate to the best of your knowledge and does not infringe anyone's rights;
• Grant us a worldwide, royalty-free, non-exclusive license to store, display, modify, and distribute the content in connection with the Service;
• Understand that we may remove content that we reasonably believe is inaccurate, misleading, unlawful, or abusive, without notice.

You remain responsible for the content you submit.

6. Data accuracy

Fuel prices and station information shown on the Service are aggregated from third-party sources, including government registries, industry publications, operator websites, and user submissions. We do not independently verify this data and we make no representations or warranties about its accuracy, completeness, timeliness, or reliability. Prices and station details may be delayed, incomplete, stale, or simply wrong.

The Service is provided for general informational purposes only. Always confirm prices and availability at the station before relying on them. Do not use the Service for any purpose where inaccurate or outdated information could cause harm, loss, or commercial damage.

7. Intellectual property

The Service - including its design, layout, code, logos, and the curated database of fuel station and price information - is owned by Backup Experts SRL or its licensors and is protected by copyright, database rights, trademark, and other intellectual property laws.

Third-party brand names, logos, and trademarks shown on the Service remain the property of their respective owners and are used only for identification purposes. Nothing in these Terms transfers any ownership rights to you.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

9. No liability

The data shown on the Service is collected from third-party sources whose accuracy we do not control, verify, or guarantee. The Service itself is provided free of charge.

To the fullest extent permitted by law, Backup Experts SRL, its directors, employees, contractors, and affiliates accept no liability whatsoever for any loss or damage - whether direct, indirect, incidental, consequential, special, exemplary, or punitive; whether contractual, tortious, statutory, or otherwise; and whether foreseeable or not - arising out of or in connection with your use of, or inability to use, the Service or any data obtained from it. This includes, without limitation, loss of money, profits, time, fuel, travel costs, business opportunities, data, or goodwill resulting from inaccurate, delayed, missing, or outdated information.

You use the Service entirely at your own risk. If any part of this section is held unenforceable under applicable mandatory law (for example, consumer protection rules that cannot be excluded by contract), our liability is limited to the minimum extent permitted by that law.

10. Indemnification

You agree to indemnify and hold Backup Experts SRL harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Service, or your infringement of any third-party rights.

11. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

12. Newsletter and email communications

You may subscribe to our optional weekly fuel price newsletter. A subscription requires a valid email address and, for public sign-ups, confirmation through a double opt-in link. The newsletter is provided for general information only and is subject to the same disclaimers regarding data accuracy set out in these Terms.

You can unsubscribe at any time using the one-click link in each email or the controls in your account settings. Our handling of your email address for this purpose is described in our Privacy Policy.

13. Governing law and jurisdiction

These Terms are governed by the laws of Romania. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in Timișoara, Romania, except where mandatory consumer protection rules provide otherwise.
